I wish I knew the answer to stuff like that too. I’d lean toward "no" they can’t, unless in the content/branding of that site you tried to make it look like something officially apple.
Although on the flip side, we were asked at diggingintowordpress.com to remove wordpress from the domain name, so we had to go with digwp.com. Plus I remember digg.com was forced to go after a bunch of websites that used digg in the URL to enforce their trademark.
So I take that back, yeah, you probably would be screwed if Apple decided to notice it and care.
Seems ridiculous to me that a company can own a string of characters in that fashion.
